This Privacy Policy explains how Vision Future Education UK (“we”, “us”, “our”) collects, uses, shares and protects personal data about you when you visit our website at www.vision-future-education-uk.org, contact us or engage our services. It also explains the rights available to you under the UK General Data Protection Regulation (“UK GDPR”) and the Data Protection Act 2018.
We are committed to protecting your personal data and to handling it transparently and lawfully. If anything in this Privacy Policy is unclear, or if you have any questions about how we use your data, please contact us using the details set out at clause 13 below.
1. WHO WE ARE AND OUR ROLE
- For the purposes of the UK GDPR, Vision Future Education UK is the “controller” of the personal data we collect about you. This means that we determine the purposes and means of processing of your personal data.
- Our contact details, and details of how to reach the person responsible for data protection within our organisation, are set out at clause 13.
2. PERSONAL DATA WE COLLECT
- We may collect, use, store and transfer the following categories of personal data about you:
- Identity and contact data, including: name, title, postal address, email address, telephone number, and the name and age of any child on whose behalf you are enquiring;
- Enquiry and engagement data, including: the content of your enquiry or correspondence, the services in which you have expressed interest, school or university preferences, and academic or programme information you provide to us;
- Technical data, including: internet protocol (IP) address, login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access the Website;
- Usage data, including: information about how you use our Website and services;
- Marketing and communications data, including: your preferences in receiving marketing from us and your communication preferences.
- We do not knowingly collect special-category personal data (such as data revealing race or ethnic origin, religious beliefs, or health) through the Website. Where the provision of our services makes it necessary to handle such data, we will do so only on a separate, lawful basis under Article 9 UK GDPR, and we will inform you at that time.
- Where we collect personal data about a child, we do so only with the involvement of a parent or guardian, and we limit the data to what is reasonably necessary to provide the requested services.
3. HOW WE COLLECT YOUR PERSONAL DATA
- We collect personal data from you in the following ways:
- directly from you, when you contact us via the Website contact form, by email or by telephone, complete an enquiry form, request a brochure or other information, engage our services, or correspond with us;
- automatically, as you interact with the Website, through cookies and similar technologies. Please see our Cookie Policy for further information; and
- from third parties, such as referral partners, schools or universities, where you have authorised that information to be shared with us.
4. LEGAL BASES AND PURPOSES OF PROCESSING
- Under the UK GDPR we will only use your personal data when the law allows us to. The legal bases on which we rely, and the purposes for which we use your data, are set out below.
- Performance of a contract with you, or to take steps at your request prior to entering into a contract — we use your data to respond to enquiries, provide quotations and proposals, deliver advisory and admissions-support services, and administer the engagement;
- Compliance with a legal obligation — we use your data to comply with applicable laws, regulatory requirements and lawful requests from competent authorities;
- Our legitimate interests — we use your data to operate, improve and secure our Website and services, to keep records of our business, to manage client relationships, and (where you have not opted out) to send you limited marketing communications about services likely to be of interest to you. In each case we have considered your rights and reasonable expectations before relying on this basis; and
- Consent — where we rely on consent (for example, for certain electronic marketing or non-essential cookies), you have the right to withdraw your consent at any time. Withdrawal of consent does not affect the lawfulness of any processing carried out before the withdrawal.
5. MARKETING
- We may send you marketing communications about our services where you have provided your contact details and have not objected to receiving such communications. You may opt out of marketing communications from us at any time by following the unsubscribe link in any email, or by contacting us at the details below.
6. DISCLOSURES OF YOUR PERSONAL DATA
- We may share your personal data with:
- service providers acting as processors who provide IT, hosting, communications and similar services to us, in each case subject to written contractual safeguards;
- professional advisers (including lawyers, accountants and insurers);
- schools, universities, examination bodies and other institutions, only to the extent reasonably necessary to provide the services you have requested and with your knowledge;
- courts, regulators or other authorities where required by law or for the establishment, exercise or defence of legal claims; and
- any prospective seller or buyer of our business or assets, in the event of a restructuring, sale or similar transaction.
- We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes.
7. INTERNATIONAL TRANSFERS
- Because our clients are based in both the United Kingdom and the People’s Republic of China, your personal data may be transferred to, and stored at, a destination outside the United Kingdom. Whenever we transfer your personal data outside the United Kingdom, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is in place:
- the country has been deemed by the United Kingdom to provide an adequate level of protection;
- we use specific contracts approved for use in the United Kingdom (such as the UK International Data Transfer Agreement or the UK Addendum to the EU Standard Contractual Clauses), which give personal data the same protection it has in the United Kingdom; or
- another lawful transfer mechanism under the UK GDPR is in place.
8. DATA SECURITY
- We have put in place appropriate technical and organisational security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. We also limit access to your personal data to those of our employees, agents, contractors and other third parties who have a business need to know.
- We have procedures in place to deal with any suspected personal-data breach and will notify you and any applicable regulator (such as the Information Commissioner’s Office) of a breach where we are legally required to do so.
9. DATA RETENTION
- We will retain your personal data only for as long as reasonably necessary to fulfil the purposes for which we collected it, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. In considering retention periods, we take into account the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure, and the purposes for which we process the personal data.
- In some circumstances we may anonymise your personal data (so that it can no longer be associated with you), in which case we may use such information indefinitely without further notice to you.
10. YOUR LEGAL RIGHTS
- Under the UK GDPR you have the following rights in relation to your personal data:
- the right to be informed about the collection and use of your personal data;
- the right of access to your personal data and to a copy of it;
- the right to rectification of inaccurate or incomplete personal data;
- the right to erasure of your personal data in certain circumstances (the “right to be forgotten”);
- the right to restrict processing in certain circumstances;
- the right to data portability in certain circumstances;
- the right to object to processing, including processing based on our legitimate interests and processing for direct marketing; and
- the right to withdraw consent at any time where we rely on consent to process your personal data.
- You will not normally have to pay a fee to exercise these rights. We may, however, charge a reasonable fee, or refuse to comply, if your request is clearly unfounded, repetitive or excessive.
- If you wish to exercise any of these rights, please contact us using the details at clause 13. We will respond within one month of receiving your request, although we may extend this period in complex cases.
- You also have the right to lodge a complaint with the Information Commissioner’s Office (“ICO”), the United Kingdom supervisory authority for data-protection matters (www.ico.org.uk). We would, however, appreciate the opportunity to address your concerns before you contact the ICO.
11. CHANGES TO THIS PRIVACY POLICY
- We keep this Privacy Policy under regular review. Any changes will be posted on this page, and where appropriate we will notify you by email or by a prominent notice on the Website. Please check this page from time to time to take notice of any changes.
